What does ListMyHouse.com offer?

ListMyHouse.com is a powerful service for listing homes on the Multiple Listing Service - the MLS. The MLS is what realtors use most when selling and searching for property. ListMyHouse.com offers a low flat fee alternative to paying a high listing agent commission to sell your house on the MLS. We will list your house on the MLS and let you do the rest. Of course, this kind of limited service would not be suitable for a seller expecting full agent representation. ListMyHouse.com is best fitting for those sellers who are seeking to save money by replacing the typical listing agent commission with a low flat fee and who want to be fully involved in their house selling process. We do not want to keep the power of MLS away from sellers attempting to sell their own house. We believe there should be an additional option to the typical listing agent commission making the home selling process less costly for sellers. For ListMyHouse.com sellers, if a commission is to be paid at all, it is a predetermined commission set by the seller, and only paid to an agent who procures the buyer. Sign up, save money and keep your for-sale-by-owner status! When a commission is split in a co-broker fashion, typically the high commission percentage is split evenly between the listing agent, for listing the property on MLS, and a buyer's agent, for procuring a buyer. Many transactions are conducted in this fashion and we are here to offer a low cost alternative to having your house listed on the REALTOR MLS.

What does ListMyHouse.com offer?

Yes. ListMyHouse.com is a limited service real estate office owned and operated by Michael J. Richards, Esq. who is a lawyer, real estate broker and REALTOR located at 12 Tower Office Park, Woburn, MA 01801 and is licensed by the Commonwealth of Massachusetts and State of New Hampshire. The agency relationship for a "flat fee listing" from ListMyHouse.com is that of a facilitator agent and not a traditional "Seller Agency" or "Buyer Agency" that other real estate agents may offer. What is the MLS?

The primary purpose of the MLS is to provide a facility to publish a "unilateral offer of compensation" by a listing broker, to other broker participants in that MLS. In other words, the commission rate that is offered by the listing broker is published within the MLS to other cooperating brokers. This offer of compensation is considered a contractual obligation. Since the commission for a transaction as well as the property features are contained in the MLS system, it is in the best interests of the broker participants (and thereby the public) to maintain accurate and timely data. The MLS is what real estate agents use most when buying and selling property and is responsible for many of the real estate transactions conducted. A limitation of the MLS is that you need a real estate agent to list your property so a for-sale-by-owner is forbidden from listing on the MLS unless he/she engages an agent. ListMyHouse.com provides listing access to the MLS for a low cost to home sellers.

Do I need to offer compensation to a Buyer's Agent?

Yes. If you don't offer compensation to buyer agents, then you cannot expect buyer agents to show your property. While the MLS does require that some compensation be offered to buyer agents in the form of a dollar amount or percentage, the MLS does not require a minimum amount to be offered. However, to keep the integrity of the MLS and ListMyHouse.com high, we require that sellers offer 2.0%, 2.5% or 3% (you choose) to buyer agents. Most buyer agents work extremely hard for their compensation and should be paid a market rate of commission. However, if a buyer finds your house on the MLS without the assistance of a real estate agent then no fee will be paid other than the original listing fee to ListMyHouse.com. You always remain a for-sale-by-owner even if the buyer found your listing on the MLS.

What if ListMyHouse.com finds a Buyer?

We will hand ever inquiry about your home to you and will never attempt to claim a buyer's agent fee. You will receive all buyer inquiries.

Will my listing be on REALTOR.com and Boston.com?

Yes. REALTOR.com and Boston.com (MA only) will pull the listing from the MLS system. If any pictures or data changes are made, these will also be reflected on these websites.

How long will my listing be displayed for?

As long as you want. When you sign-up, you will be required to post a start date and an end date.

Can I use my own lawn for-sale sign?

No. MLS prohibits any sign to be posted on a property that is listed on the MLS unless it is from the office of the listing agent. Accordingly, the only for-sale sign you can have on your property is a yard sign from ListMyHouse.com. If a seller violates this policy, the seller must pay any fines that ListMyHouse.com receives from the MLS.

Can I cancel my listing?

Yes. There is no exclusive-right-to-sell and you can cancel at any time with the exception of during the time that an offer is being procured, negotiated or agreed upon.

What other websites will my listing be on?

Many other websites will pull your listing. This process and data displayed is outside the control of ListMyHouse.com but rather is a service that MLS provides with the cooperation of other websites. These websites are as follows:

Who takes care of all the paperwork?

You can hire us to handle the offer, purchase and sale agreement, draft the deed, provide support and hold the buyer's deposit for an additional fee of $500.00. If you wish to engage our office for these services, please let us know. Our agency relationship will always remain as a "facilitator agent" (see our agency disclosure for the definitions of various agency types).

Who provides photography of my home?

You must supply us with all pictures. Take a look at other listings to see how pictures are taken. Make sure your pictures are not dark and the background is clean.

How does a an agent or buyer contact me directly?

Real Estate Agents can view your name, number and email address directly from the listing. The seller's name, number and email is only viewable to agents on the MLS so others must go to ListMyHouse.com and click the "Contact Sellers" button to retrieve seller contact information.

May the Buyer contact the Seller directly after a Realtor shows the home to him/her?

Yes. However, the Seller is still obligated to pay a commission to the Realtor who showed the home.

May the Seller continue to advertise as a FSBO?

Yes, the Seller is free to advertise (e.g. newspapers), hold open houses, and/or do anything that he/she wants to help sell his/her home.

What type of rules must the Seller abide by when selling through this program?

The Seller must comply with all fair housing laws and MLS Rules & Regulations (download to review the details).

Do I have to pay to make changes to my listing?

Never, the price that you paid is final. There is never an extra charge to change price, pictures, or listing status.
